Simplified TOSLast updated January 9, 2025My entire TOS can be found below. For clarity and improvement of your consumer experience, I have summarized my TOS in this section.GENERAL
• All requests must abide by VGen TOS and must not contain illegal material.
• I reserve the right to decline any commission request. Please review the "will & will not draw" section above to ensure I can complete your request.
• If you have any questions or would like to discuss a commission, please email me at [email protected]
• I may share WIPs of your commission throughout the creation process. If you would like for me not to, please be sure to add the NDA when purchasing (+15%).
• Breaking my TOS will result in you being blocked and blacklisted, which means you will not be able to purchase from me in the future.PAYMENTS
• I only accept PayPal payments at the moment.
• Items $150 and under must be paid in full before I begin working.
• For items above $150, you may choose to pay full upfront OR half upfront and half after the commission is completed. At least half of the total must be paid before I begin working.REFUNDS
• Refunds will only be provided for cancelled orders.
• Cancellations may only be done within 24 hours of purchase and cannot be done after a commission has been completed. Cancellations will result in a full refund unless I have begun working on the artwork.
• If the artwork cannot be completed due to complications on my end, I will cancel the order and therefore provide a full refund.To cancel a request, please email me at [email protected] with the subject line "Cancel My VGen Order" or contact me through whichever means we have been discussing your commission (Discord, VGen DMs, etc).REVISIONS
• Communication is VITAL throughout this entire process. Please be direct and assertive with your request so I can make the best piece for your needs.
• I will edit and revise as many times as needed during the sketching stage. I require approval before moving forward to the next step of the process and as a result, I will NOT make changes during lineart/inking.
• If you are dissatisfied with the colors when I share the update of the commission with base colors done, please say so in that moment. I will only make changes to colors then and will not in the later stages of the coloring and rendering process.
• Once the final artwork is provided, I will gladly make
minor changes to ensure you are satisfied with the final product.DEADLINES AND DELIVERY
• Upon accepting a request, I will provide a date of completion. I guarantee the piece will be completed by this date (or by your chosen deadline). I will generally complete a commission within 14 days of payment, but this may be shorter or longer depending on my workload.
• If the artwork cannot be completed due to complications on my end, I will cancel the order and therefore provide a full refund.
• If I am certain I cannot meet your deadline, I will not accept your commission request.USE
• My art (commissioned or otherwise) must NOT be used for machine-learning or development of generative AI.
• My art (commissioned or otherwise) must NOT be used for NFTs.
• My art (commissioned or otherwise) must NOT be used for anything illegal.
• You must purchase a commercial license (+50%) if you intend to use my artwork for merch, sales, or promotional material. You may purchase a tattoo ticket ($5) if you intend to get my artwork tattooed.
• All personal use is permitted for your commissioned artwork.
• Credit is not necessary when sharing pieces you have commissioned from me, but it is appreciated.INTELLECTUAL PROPERTY RIGHTS
• Explicit credit ("Artwork by @sootbat") is not necessary. Still, you are not allowed to claim that you or someone else has created the artwork. If asked, you are required to state that I (sootbat) was the artist who made it.
• Purchasing a commercial license grants you the rights to monetize, sell, market, or commercialize the artwork. A commercial license cannot be transferred or traded to another party and is owned exclusively by the person/business who purchased the license from me (sootbat).
• Do not edit or alter the artwork. A commercial license does not grant the right to edit or alter the artwork. Please contact me via email ([email protected]) if you would like to modify the artwork and we can discuss how to approach your new concept.COMMUNICATION
• (For VGen) All communication regarding the commission will be done through your preferred method of contact provided when ordering.
• (For VGen) If I am unable to contact you through a preferred method of contact (ex. Discord), I will email you at the email address attached to your order.
• All contact will be regarding your commission exclusively. Commissioning me does not grant the right to contact me for unrelated matters. I will cease contact when the order has been completed. If you would like to chat in a more casual manner, you are welcome to check out my socials. Messages/emails regarding commissions will be strictly professional.

Refunds & Returns PolicyLast updated January 9, 2025Attempting to circumvent this Refunds & Returns Policy by contacting a provider such as PayPal, VGen, or a bank rather than contacting sootbat directly will be considered fraud, especially if the order has already been delivered. Those who commit this fraud not allowed to purchase from sootbat again.I. RETURNS
Digital goods are not eligible for returns or replacements.sootbat does not accept returns, but is willing to replace damaged goods within 21 days of purchase. If 21 days have passed since the original purchase, a replacement will not be provided.To be eligible for a replacement, the Product must be unused (ex. stickers must have their backing covering the adhesive side). Items with clear signs of use or natural wear are not eligible for replacements.Items may only be replaced with the same item or an item of equal value.To discuss a replacement, sootbat requires a receipt or proof of purchase, name and email on the order, order number (if applicable), and photos of damage, as well as any relevant information such as the condition of the letter/package it arrived in.Do not attempt to return the Product before contacting sootbat. You may contact sootbat via email ([email protected]).II. CANCELLATIONS
Cancellations are accepted within 24 hours of purchase and cannot be done after the Product has been shipped (for physical goods) or after a service has been provided to completion.Cancellations result in a refund and ceasing of any binding agreements to provide a Product.III. REFUNDSRefunds are provided only upon cancellation and not under any other circumstance.IV. ALIGIBILITYDigital goods are not eligible for returns or replacements.

INTRODUCTIONThese Terms apply to all Products on sootbat's VGen (https://vgen.co/sootbat), as well as all Products listed on sootbat's Carrd (sootbat.carrd.co/#prices). You may be bound by additional contracts enforced by the host platform, VGen. If any provisions of the additional contracts conflict with any provisions of these Terms, the provisions of the additional contracts will control and prevail.III. - the quality of Products will meet your expectations.Nothing on sootbat's VGen or Carrd is meant to constitute, legal, financial or medical advice of any kind. If You require advice, you should consult an appropriate professional.VII. WAIVERFailure to enforce any of the provisions set out in these Terms, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms, or the right thereafter to enforce each and every provision.VIII.
